Policies and Agreements

Internet Billing Agreement

LVT Corp. will bill for Internet Access Service monthly. Payments are due when the bill is rendered and are payable at any payment center designated by LVT Corp. If payment in full is not received by the due date (10th of month), the account will be considered in default and service will be temporarily terminated. If your account is disconnected for any cause, you will be charged $25.00 to be reconnected.

LVT Corp. invokes a return check charge policy. A $15.00 return check fee will be added to your account.

Service may be canceled by either party, at any time, with no penalty. If you elect to terminate your service in this manner, charges will cease upon receipt by LVT Corp. of your request. Only Full Months Prepaid will be refunded (no partial month refunds).

LVT Corp. reserves the right to change the rates and otherwise modify these Terms and Conditions by notifying you 10 days in advance of the effective date of the change. If you do not request your service to be terminated, it will be conclusively presumed that you consent to the new terms, conditions, and rates as notified.

LVT CORP. MAKES NO WARRANTIES OF ANY KIND, WHETHER EXPRESSED OR IMPLIED, FOR THE SERVICE IT IS PROVIDING. LVT CORP. ALSO DISCLAIMS ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. LVT Corp. intends that the service be used for educational and recreational purposes only. LVT Corp. will not be responsible for any damage you suffer. This includes loss of data resulting from delays, non-deliveries, mis-deliveries, or service interruptions caused by LVT Corp.’s own negligence or your errors or omissions.

MWT may only be used for lawful purposes. Transmissions of any material in violation of a US or state law, rule or regulation is prohibited. This includes, but is not limited to: copyrighted material, material legally judged to be threatening or obscene, by local community standards, or material protected by trade secret, or inappropriate language used while in a chat room. You agree to indemnify and hold harmless LVT Corp., its affiliates, employees, officers, directors and suppliers from any claims resulting from your use of the service, which damages you or another party.

MWT service is provided by LVT Corp. and you understand that if you are unable to utilize the service for any reason you will still be responsible for payment unless you notify us in advance and request service to be terminated.

THE LVT CORP. UNLIMITED ACCESS PLAN IS NOT INTENDED FOR LONG-TERM CONNECTIONS. SESSIONS ON THE UNLIMITED DIAL-UP ACCOUNTS WHICH EXCEED A REASONABLE TIME MAY BE TERMINATED IN ORDER TO PROTECT NETWORK RESOURCES AND PRESERVE SERVICE AVAILABILITY FOR OTHER USERS. IN THE EVENT LVT Corp. DETERMINES THAT AN ACCOUNT IS EXCEEDING THE RELEVANT BANDWIDTH OR DISK UTILIZATION OR FREQUENTLY EXCEEDING REASONABLE SESSION TIMES FOR DIAL-UP ACCOUNTS, THE ACCOUNT OWNER WILL GENERALLY BE NOTIFIED BY E-MAIL. IF THE EXCESS USE CONTINUES AFTER SUCH NOTIFICATION, THE OWNER MAY BE REQUESTED TO UPGRADE THE ACCOUNT’S SERVICE AGREEMENT OR TO MODIFY THE ACTIVITY CREATING THE EXCESS USE, OR THE ACCOUNT MAY BE TERMINATED.

Internet Services — Subscriber Agreement TOS

Midwest Tel Net provided by LVT Corp., a subsidiary of Lemonweir Valley Telephone Co., hereinafter referred to as MWT, is provided to you “as is.”

You may only use MWT for legal purposes. You may not use MWT or its services to publish, post, distribute or disseminate any defamatory, obscene, or other unlawful material or information, including another’s proprietary information, including trademarks or copyrighted information, without express authorization from the rights holder. Additionally, you may not use MWT to collect or harvest personal information, including internet addresses, about MWT users.

You must abide by any policies posted on MWT or mailed to you by LVT Corp. You understand that MWT provides no assistance, including the review, removal or editing of content posted on, or any customer support for the use of, the MWT Web site(s).

LVT Corp. and Midwest Tel Net uses their best efforts to maintain MWT but are not responsible for the results of any defects that exist in MWT, or any resulting lost profits or other consequential damages. You should not assume that MWT or its content is error-free or that it will be suitable for the particular purpose that you have in mind when using it. LVT Corp. and/or Midwest Tel Net may, in their sole discretion and at any time, modify or discontinue MWT; limit, terminate or suspend your use of or access to MWT; and/or make changes to these Terms of Use.

Midwest Tel Net and LVT Corp. Software Registration Agreement
Your use of the Midwest Tel Net and LVT Corp. software; (the “Software”) constitutes your acceptance, and agreement with LVT Corp. and Midwest Tel Net as follows: You understand and reaffirm your agreement to LVT Corp.’s and Midwest Tel Net’s then-current Terms of Service. You further agree and acknowledge that by using the Software to access the MWT service, you will be subject to any applicable charges for the use of the MWT service as set forth in the terms and conditions of the pricing plan you have chosen.

You understand that MWT or LVT Corp. provides no assistance, including any technical or customer support, in the use of the Software, and that your use of the Software is at your own risk. The Software is provided “AS IS” and “AS AVAILABLE” and no warranties are provided, except as required by law. SPECIFICALLY, THE WARRANTIES FOR MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE HEREBY DISCLAIMED.

LVT Corp. and Midwest Tel Net are in no way liable for any claims arising from your use of the Software. As a condition of your use, you agree to indemnify LVT Corp. and Midwest Tel Net for all claims relating to your downloading, use, reproduction of, and/or receipt or distribution of content through, the Software. MWT and/or LVT Corp. reserves the right, in their sole discretion and at any time, to modify or discontinue the Software; limit, terminate or suspend your use of the Software; assess charges for the use of the Software in the future; and/or make changes to this Registration Agreement.

The documents and information provided by LVT Corp. and Midwest Tel Net are copyrighted materials of LVT Corp. and its information providers. Reproduction or storage of materials retrieved from this service is subject to the U.S. Copyright Act of 1976, Title 17 U.S.C.

Copyright Complaints
MWT respects the intellectual property of others, and we ask our subscribers to do the same. MWT may, in appropriate circumstances and at its discretion, terminate the accounts of users who infringe the intellectual property rights of others.

  1. If you believe that your work has been copied and is accessible on the MWT service in a way that constitutes copyright infringement, you may notify MWT by providing MWT’s copyright agent the following information;
  2. An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest;
  3. A description of the copyrighted work that you claim has been infringed, including the URL (i.e., web page address) of the location where the copyrighted work exists or a copy of the copyrighted work;
  4. Identification of the URL or other specific location on the MWT site where the material that you claim is infringing is located;
  5. Your address, telephone number, and email address;
  6. A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; a statement by you, made under penalty of perjury, that the above information in your Notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.

Internet Policies

Consumer Internet Services Info & Policy

Lemonweir Valley Telephone Co. is a proud member of the Midwest TelNet (MWT) consortium. Midwest TelNet’s Web Page offers a bulletin board for users to exchange information, interesting web sites and information about Midwest TelNet’s members (such as Lemonweir Valley Telephone Co.) You may want to make Midwest TelNet your Internet start page. To find out your Internet usage for the month or change your password, simply click on the Support button on Midwest TelNet’s home page. Access your Postini junk email and virus filtering service on MWT’s home page. Please take a few minutes to review Midwest TelNet’s Acceptable Use Policy.

Billing Information

For Lemonweir Valley Telephone Company telephone customers, your Internet billing will be included on your monthly telephone bill. For Lemonweir Valley Telephone Company Internet only customers, you will receive a separate monthly Internet bill from LVTC. In both situations, you are billed one month in advance. The monthly billing cycle will be from the 1st of the month to the end of the month. The billing will begin on the 1st of the month after you sign up. Any prior usage will be considered free set-up time.

Service Description

 

Service Offerings

Airstream Communications and Wisconsin Independent Network directly offer broadband ISP services directly and through various Internet providers in select markets. Pricing for direct Internet connectivity provided to business customers is determined on an individual case basis.

Performance

Airstream and WIN offer a speed test site to any user or customer. It can be accessed here: Airstream Speed Test.

Congestion Management

Airstream and WIN do not implement any congestion management techniques. Airstream and WIN engineer and operate their network to accommodate the necessary traffic requirements, with ample capacity and redundancy to address peak traffic levels in the case of a partial network outage. In the event of congestion, all traffic is classified as best effort.

Content, Applications, Service and Device Providers

As a full service Internet Service Provider, Airstream and WIN deliver a full suite of Internet-based applications. These include:

– Email
– Web Hosting
– File Transfer Protocol

Airstream and WIN do not discriminate any customer traffic. Both companies utilize network management techniques that are equal and standard across all user applications. We do not modify our network to make our directly served applications perform better than applications a user would access over the general Internet. For example, Airstream and WIN do not manipulate our network to perform better for customers accessing Airstream email servers versus Airstream customers accessing Google’s gmail servers.

The network management practices employed by Airstream and WIN do not differ between our directly offered applications to those general applications offered over the Internet.

Security Measures

In the event of Denial of Service (DoS), Distributed Denial of Service (DDoS) attack,spoofing or other malicious traffic, Airstream and WIN will implement inbound and outbound traffic filtering and/or blocking on specific source and destination IP addresses. These actions will be performed to ensure reliability and availability of the Airstream and WIN network. These actions will not be utilized for normal Internet applications and traffic. In the case of any suspicious or malicious network activity, notification and forensic information will be made available to the appropriate law enforcement and network security resources for investigation.

Payment Information

Lynxx services are billed one month in advance and pro-rated to the day the service was established.

Lynxx bills are delivered by the first of the month and are due by the tenth of the month.  Lynxx offers automatic payment of your monthly statement via automatic withdrawal from a checking or savings account or automatic payment by a debit or credit card.

Lynxx offers the service of emailing monthly statements to its customers. It is very simple, contact Lynxx with your valid email address and your statement will be emailed to you each month at the email address you provide us.

Customers may also mail their payments to Lynxx using the bill stub, check or money order and the return envelope provided in the monthly statement.

The F & M Bank in Hustler and the Royal Bank in New Lisbon accept Lynxx payments up to the 10th of the month.

For the customer’s additional convenience, there are payment drop box locations at 201 Leer Street in New Lisbon, 127 U.S. Hwy 12 in Camp Douglas and 122 Main Street in Camp Douglas.
