The following is a description of Lemonweir Valley Telephone Company and LVT Corp d/b/a Lynxx Networks Privacy Policy for its Internet Access Services or subscribing to its Video Services, or by visiting its website, you are consenting to Lynxx Networks’ information gathering and use practices as in effect from time to time.  If you have questions or concerns about this Privacy Policy as it applies to Lynxx Networks’ services, please do not hesitate to contact us via telephone at 608-427-6515.


Information Collection

Lynxx Networks collects information from subscribers at several different points as it provides the internet access or video services.  Lynxx Networks is the sole owner of the information it collects in the course of providing internet access and video services.

Lynxx Networks’ website creates and uses “cookie” technology.  “Cookies” are strings of text that a website stores on a user’s computer.  Cookies enables a website to keep track of a user’s preferences and activities relating to that website.


Use of Information

Lynxx Networks uses information it obtains in the course of providing its services and from its website for the following purposes:

Internal marketing and analysis to subscribers who have consented to Lynxx Networks offering those services to them;


Order Processing;

To maintain and administer the services it provides;

To satisfy legal requirements, including but not limited to, responding to legal demands for information and enforcing Lynxx Networks’ use policies; and

As appropriate in situations that Lynxx Networks reasonably considers to be emergencies involving personal safety.

Lynxx Networks will not sell, share or rent Subscriber’s information to others in ways other than as described in its Privacy Policy.  We may share aggregated demographic information with Lynxx Networks’ service providers.  This information is not linked to any personal information that can identify any individual person or entity.


Links and Other Non Lynxx Networks Sites

This Privacy Policy applies solely to information collected by Lynxx Networks from its provision of Internet access services, video services and from its website. Lynxx Networks’ website may contain links to other sites.  Lynxx Networks may also host websites designed and used by others.  Lynxx Networks is not responsible for the privacy practices of sites other than its own.  Lynxx Networks encourages subscribers to be aware when they leave Lynxx Networks’ site and to read the privacy statements of each and every website that collects personally identifiable information.


Minors

Lynxx Networks’ website and its information gathering in connection with Lynxx Networks’ other services are not intended to collect information about minors. Persons under age 18 should use this and Lynxx Networks’ video and internet access services, only with the supervision of a parent or guardian.


Security

Lynxx Networks takes commercially reasonable precautions to protect our user’s information.  When subscribers submit personal information via the internet or via Lynxx Networks’ website, the information is protected both online and off-line.  All of our users’ information is restricted in our offices.  Only employees who need the information to perform a specific job (for example, a customer service representative) are granted access to personally identifiable information.  All employees are kept up-to-date on Lynxx Networks’ security and privacy practices. Notice of Change

If Lynxx Networks decides to change this Privacy Policy, Lynxx Networks may post those changes on this site so our users are always aware of what information we collect, how we use it and under what circumstances, if any, we disclose it. If at any point we decide to use personally identifiable information in a manner different from that stated at the time it was collected, we will notify users by way of an email.  Users will have a choice as to whether or not we use their information in this different manner.  We will use information in accordance with the privacy policy under which the information was collected.

Each subscriber has the right to review all personally identifiable information regarding the subscriber that is collected and maintained by Lynxx Networks. That information will be made available to a subscriber at Lynxx Networks’ office at 12 7US Highway 12/16, Camp Douglas, WI 54618, during regular business hours, upon the subscriber’s request.  Subscribers will be given a reasonable opportunity to collect any errors in the personally identifiable information Lynxx Networks has collected concerning that subscriber.

Lynxx Networks retains personally identifiable information only for as long as it is needed for Lynxx Networks’ business purposes.  Lynxx Networks is required to destroy personally identifiable information if it is no longer necessary for the purpose for which it was collected and there are no pending requests or orders for access to that information by the subscriber or pursuant to a court order.

Any person aggrieved by Lynxx Networks’ violation of the Privacy Act may bring a civil action in the United States District Court for actual, punitive damages, reasonable attorney fees and other reasonably incurred litigation costs. This remedy is in addition to any other lawful remedy available under federal or state law.


Privacy

Lynxx Networks treats email messages as private.  Exceptions are those permitted by law including, for example (I) as necessary to operate the system or protect Lynxx Networks’ rights or property; (II) upon legal demand or court orders, warrants, subpoenas; or (III) where Lynxx Networks received information inadvertently which appears to pertain to the commission of a crime.  Subscribers should be aware that electronic messages may be intercepted lawfully or unlawfully outside of Lynxx Networks’ system.  In addition, although Lynxx Networks implemented certain security measures, Lynxx Networks cannot guarantee that its system or stored data of a subscriber will be free from unauthorized intrusion or otherwise guarantee the privacy of information of any subscriber.  Subscriber consents to Lynxx Networks’ collection and use of personal information collected in the course of Lynxx Networks’ providing services to subscriber.  Lynxx Networks’ collection and use subscriber’s personal information is subject to the terms of Lynxx Networks’ privacy policy as posted on its website at www.getlynxx.com.


Interception and Enforcement

Subscriber agrees that exclusive jurisdiction for any claim or dispute arising from use of Lynxx Networks’ service resides in the courts located in the State of Wisconsin.  Subscriber consents to the personal jurisdiction of the courts located in Wisconsin, as to any claim or dispute arising from use of Lynxx Networks’ service.  These Terms of Service supersede all other written or oral communications or agreements with regard to the subject matter.  A waiver or modification of these Terms of Service shall only be effective if in writing signed by an authorized officer or Lynxx Networks.  These Terms of Service shall be governed by and interpreted in accordance with the laws of the State of Wisconsin without regard to conflict of law principles.  If any of these Terms of Service is found to be unenforceable or invalid, the remaining provisions shall be enforceable and valid to the greatest extent permitted by law.  These Terms od Service apply in addition to any Internet access service or web hosting agreement between Lynxx Networks and the subscriber.


Lynxx Command IQ Mobile Lynxx Command IQ Application

Who is covered by this Privacy Policy?

Lynxx Command IQ is an Lynxx Command IQ Application developed by Calix, Inc. for use by subscribers of broadband service providers (BSPs) who purchase cloud and software services from Calix, Inc. Calix, Inc. is a processor of (or service provider for) its BSP’s subscriber personal information under Lynxx Command IQ Applicable privacy and data protection laws. Lynxx Networks is the controller of its subscriber personal information, determining how and why your information is processed. As such, subscribers should refer to Lynxx Networks’ privacy notice for details on how the BSP processes subscriber personal information. If you do not agree with the Lynxx Networks Privacy Policy, you should not install, use, or access the Lynxx Command IQ Lynxx Command IQ App.

The Lynxx Command IQ App is not intended for children under 16 years of age, and Calix does not knowingly collect personal data of children under 16, without parental consent. If Calix learns that personal data from a child under 16 has been obtained or received without verification of parental consent, Calix will delete that information. If you believe Calix might have any information from or about a child under 16, please notify Calix by completing a Request Form (clicking the link will take you to TrustArc, whom Calix has engaged to assist with personal information requests).


How Calix Collects Your Information:

On behalf of Lynxx Networks Calix collects and processes information provided directly by you when you install the Lynxx Command IQ App and register for an account to use the Lynxx Command IQ App. Specifically, this information includes:

  • Your name, email address, password/pin, preferred language, and your account number
  • Information about the equipment deployed at your premises that you choose to connect to the Lynxx Command IQ App such as the MAC address, serial number or other unique identifier for your router;
  • Data insights Calix attains based on correlation and analytics of your information collected in providing the Lynxx Command IQ App, and user-associated analytics to improve the quality of the Lynxx Command IQ App experience.


How Calix Uses the Information:

On behalf of Lynxx Networks Calix uses the information collected as described in this Privacy Policy, to:

  • Provide you with the Lynxx Command IQ App and the Services/notifications provided through the Lynxx Command IQ App as described in the Agreement;
  • Implement, improve and/or enhance the Lynxx Command IQ App or to provide Lynxx Command IQ App features, including to make future releases available to you;
  • Carry out Calix’s obligations as described or authorized in the Agreement, Lynxx Networks’ privacy notice, and this Privacy Policy;
  • Enforce Calix’s rights arising from the Agreement between you and Calix; and
  • Fulfill any other purpose authorized by you and reasonably required for the Lynxx Command IQ App.

Lynxx Networks may also use the information collected as described in this Privacy Policy, to inform you about goods and services that may be of interest to you.


Disclosure of Information:

Calix does not sell or otherwise distribute or disclose your information to third parties other than as described or authorized in the Agreement, including this Privacy Policy.

Calix discloses the information to its subsidiaries, affiliates and certain third-party vendors and contractors that provide development, integration, web hosting, and consulting services to Calix to provide you with the Lynxx Command IQ App, to maintain, support, develop, improve and/or enhance the Lynxx Command IQ App and to fulfill Calix obligations associated with the Lynxx Command IQ App.

Calix may be required to disclose information under certain circumstances:

  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request;
  • To enforce Calix’s rights arising from the Agreement entered into between you and Calix;
  • If Calix believes disclosure is necessary or Lynxx Command IQ Appropriate to protect the rights, property, or safety of Calix, its customers or other third parties; or
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Calix’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which your information and/or your subscriber information held by Calix are among the assets transferred.


Your Choices About Our Collection, Use, and Disclosure of Information:

The provision of the information described in this Privacy Policy is necessary for you to use the Lynxx Command IQ App.

Your information is retained and used as described in this Privacy Policy. If you delete your account for the Lynxx Command IQ App in accordance with the terms of the Agreement, your information will be deleted within 30 days of the deletion of such account or within such other timeline as may be mandated by Lynxx Command IQ Applicable law. You will no longer be able to access the Lynxx Command IQ App when your account is deleted.


Accessing and Correcting Information:

You can (a) access and review your contact information, and (b) correct your contact information, by logging into the Lynxx Command IQ App and visiting the settings page. To access, review or correct any other information, please reach out to your BSP.


Data Security:

All information you provide to us is stored on our secure servers behind firewalls. Calix utilizes mechanisms such as intrusion detection systems, intrusion prevention systems, firewalls, and encryption to secure information from accidental loss and from unauthorized access, use, alteration, and disclosure.

Calix deploys Intrusion Detection Systems (IDS) and Intrusion Prevention Systems (IPS) to alert and proactively contain potential threats. Enhanced security visibility and coverage is enabled through added layers of firewall and IDS beyond the network perimeter. Management connections to servers are always authenticated and encrypted via Secure Shell (SSH) when administration access is required for troubleshooting, patch management, and upgrades.

Calix runs automated vulnerability scanning on all perimeter systems to identify potential security risks. Scanning Lynxx Command IQ Applications are regularly updated to remain current and up to date on important security vulnerabilities. Patches are Lynxx Command IQ Applied to all relevant systems unless a compensating control is implemented.

Calix uses a variety of industry-standard security technologies and best practices to help protect information from unauthorized access, use, or disclosure. All data stored on the Calix systems is encrypted following industry standards using the strongest keys and ciphers. All communications with the Lynxx Command IQ App are protected with industry standard security protocols.

You control access to your account. You must keep your login credentials and passwords secure and protected and maintained as confidential. Calix is not responsible for any circumvention of any privacy settings or security measures provided.


Changes to this Privacy Policy:

The date the Privacy Policy was last revised is identified at the end of this Privacy Policy. You are responsible for periodically visiting this Privacy Policy to check for any changes.
